Mining companies must obtain federal Clean Water Act permits from the U.S. Army Corps of Engineers before they can bury a stream and the EPA has used its authority to review several of the permits. EPA developed a standard that looks at the type of life in a headwater stream. It uses the mayfly as a barometer of stream health.
